By accepting the terms and conditions of this auction you acknowledge that you are entering into a legal and binding contract. Everything sells "AS IS" and "Where Is". ANY IMPLIED WARRANTIES BY STATUTE OR COMMON LAW ARE HEREBY EXPRESSLY WAIVED. Information obtained was furnished by sources deemed reliable; however, neither the owners nor the auction company guarantees this information to be correct. All items are open to public inspection. It is the Bidder's responsibility to determine condition, age, genuineness, value, or any other factor. Fragodt Auction Company will not be responsible for any errors or omissions in the description of the item. All auctions are with reserve unless specifically stated otherwise and Fragodt Auction Company reserves the right to place a reserve bid on behalf of the seller. 

After an item is won on an auction, the buyer gives up all rights of inspecting that item before making payment.

Internet Bidding:

Fragodt Auction Company does not guarantee that bids placed online will always be transmitted to or received by the auctioneer on time. At the discretion of Fragodt Auction Co., any online auction may be suspended, postponed, or cancelled if internet service is unreliable and/or disrupts the ongoing live auction. Under no circumstances shall the bidder have any kind of claim against Fragodt Auction Company or anyone else if the internet service fails to work as intended before or during any auction.

Fragodt Auction Company also has the right to refuse, add, delete, or change any bids placed online. As well as make any changes to our Terms and Conditions governing those auctions at any time.

Fragodt Auction Company and it's sellers are not responsible for stolen, lost, or damaged items (including loading, unloading, packaging, etc) and a refund or discount will not be offered.

Fragodt Auction Company has the right to resolve any bidding issue how they see fit.

Any action commenced to enforce any of the terms and conditions set forth herein shall be venued in the District Court of Lac qui Parle County, State of Minnesota, and Fragodt Auction Co. shall be entitled to an award of reasonable attorney fees and costs incurred in said action. The terms and conditions shall be binding on the party's heirs, successors and assigns. Also, by entering into this agreement, you and Fragodt Auctions, LLC each are waiving the right to a trial by jury.

Sales tax will apply on applicable sales. A tax Exempt link will be provided on your invoice. It will need to be filled out and returned to Fragodt Auction Company in order to remove the sales tax. 

All online auctions will have a staggered ending. The auctions will usually close 1 item every 2 or 3 minutes, but that can change at any time. If an item receives a bid with in the last 2 or 3 minutes of that items being open, it will automatically be extended 2 or3 minutes and will continue to do so until no bids have been received in 2 or 3 minutes. Staggered ending time will be clearly visible for each auction.

Shipping and shipping arrangements are the sole responsibility of the buyer.

All items purchased on an online auction may be deemed abandoned after 45 days of the auction and may be subject to resale, and/or added storage and loading fees.

ABANDONMENT POLICY

Should buyer fail to remove purchased item(s) within forty-five (45) calendar days of winning the bid, buyer agrees to pay a storage fee of $25 per day until the item(s) is/are removed from seller’s location. All such charges shall be the sole responsibility of the buyer and paid directly to the seller. The buyer agrees to indemnify and hold harmless; seller, Fragodt Auction and Real Estate LLC, and its agents against all damages, liabilities, claims, or causes of action arising out of said property storage. If buyer fails to remove the purchased item(s) within forty-five (45) calendar days of winning the bid, buyer stipulates and consents to the fact that said purchased item(s) shall be considered “abandoned”.

In the event the sale price of said item(s) not removed was $500 or less, seller may dispose of said item(s) as seller, in seller’s sole discretion, sees fit without remuneration of any kind to buyer. In the event the sale price of said item(s) not removed exceeds $500, buyer and seller agree said item(s) will be placed for sale in the next Fragodt Auction and Real Estate LLC auction. In furtherance thereof, buyer hereby irrevocably appoints seller as its power of attorney for the purpose of re-listing and re-selling said abandoned property in such case, buyer consents to and agrees that all storage fees, handling costs, sales commissions, and a 20% administration fee for the “re-sale” of the item(s) will be deducted from the final sale price and buyer authorizes Fragodt Auction and Real Estate LLC to make such deductions. Buyer, in such event, authorizes seller, on its behalf, to transfer ownership/title to the new buyer and buyer agrees and acknowledges that any ownership interest buyer has in said item(s) shall then terminate.

In the case of titled vehicles, buyer agrees to promptly return the title for said vehicle to Fragodt Auction and Real Estate LLC within 7 days after said vehicle has been considered abandoned by these terms. In the event buyer fails to do so, buyer hereby irrevocably appoints seller as its power of attorney for the purpose of applying for a lost, or other such replacement title, including any associated paperwork needed to obtain such title, so as to allow for the disposition or re-sale thereof. In the event of re-sale, upon receipt by Fragodt Auction and Real Estate LLC of such resale amount, any proceeds remaining after the deductions as set forth herein, will be returned to the abandoning buyer, provided Fragodt Auction and Real Estate LLC is able to determine a method for doing so. It shall be the duty and responsibility of buyer to keep Fragodt Auction and Real Estate LLC updated on buyer’s correct contact information. Buyer agrees to indemnify and hold Fragodt Auction and Real Estate LLC harmless from buyer’s failure to timely remove the purchased item(s) as agreed, as well as for buyer’s failure to keep Fragodt Auction and Real Estate LLC updated on buyer’s current contact information. Fragodt Auction and Real Estate LLC also maintains the right to suspend the bidding privileges of any buyer who does not pick up item(s) purchased in the auction within the specified terms.

Entering into a separate storage agreement with the seller is between the buyer and seller, and Fragodt Auction and Real Estate LLC has no responsibility for resolving any subsequent conflicts or disagreements which arise between buyer and seller.
